HIRE TERMS & CONDITIONS

IMPORTANT INFORMATION & DISCLAIMER

ELIGIBILITY, OWNERSHIP & PERMITTED USE

Hire is for MODE Official Dealers and suitably qualified automotive technicians only. The equipment remains MODE property.

Use it only for supported applications and procedures, with tuning/calibration files supplied by MODE. Third-party or

independently supplied files are not permitted.

HIRE PERIOD, TRANSIT & RETURN

The selected hire period and booking/order terms determine when hire starts and ends, and whether shipping/transit time is

included. Transit risk rests with the dealer unless otherwise agreed. Return the complete kit, including all cables and

accessories, clean and in acceptable condition in the supplied case. Late returns may incur additional hire charges at MODE’s

standard rate per day or part day.

SAFE OPERATION & COMPATIBILITY

The dealer is responsible for safe use, storage and security from delivery until MODE receives the equipment back. Confirm

compatibility before work; support may vary with ECU hardware, software version, production date and programming history.

Incorrect connection, power loss, communication interruption, improper operation or pre-existing ECU faults can cause

programming failure, ECU corruption or vehicle faults.

EQUIPMENT BOND & LIABILITY

A $750 refundable equipment bond is payable in addition to the hire fee. It is refunded after return and inspection of the

complete kit in acceptable condition. MODE may deduct reasonable amounts for missing or damaged equipment or

accessories.

The dealer is responsible for loss, theft, damage or misuse while the equipment is in their care, including all supplied cables

and accessories. The professional tool/kit is valued at approximately $8,000; the supplied schedule lists the tuning tool at

$8,150, with accessories listed separately.

The $750 bond is security only and does not cap liability. Where reasonable repair or replacement costs exceed the

bond, the dealer remains liable for the balance. Retaining the bond does not discharge liability above $750.

WARRANTY & LIMITATION OF LIABILITY

Equipment is supplied “as is”, fit for its intended use at dispatch. To the extent permitted by law, MODE accepts no liability for

damage or loss arising from incorrect use, installation, connection or operation, or for indirect, consequential or special loss or

damage.

AGREEMENT & GOVERNING LAW

By ordering and accepting the equipment, the dealer agrees to the applicable MODE Pro Tuning Equipment Hire Terms &

Conditions. These terms are governed by the laws of Queensland, Australia.
